Regulation 13

Withdrawal of moneys for payment of costs, etc.

Subregulation 1

Where an application for the withdrawal of money under these Regulations has been approved by the Board and the member is required to pay any costs, fees or other expenses mentioned in section 21(1)(d) or 21B(1)(d) of the Act, the Board may, on the application of the member and subject to such terms and conditions as the Board may see fit to impose, authorise the whole or part of the amount standing to the member’s credit in the Fund to be withdrawn and used for all or any of those purposes.

Subregulation 2

To avoid doubt, where a member is required to pay any costs, fees or other expenses mentioned in section 21(1)(d) or 21B(1)(d) of the Act in connection with —

(a)

any divestment, whether by sale, transfer, assignment or otherwise, by the member of the whole of the member’s interest or title in a property; or

(b)

the discharge of any mortgage on a property upon divestment by the member of the whole of the member’s interest in such property,the member must not withdraw any amount standing to the member’s credit in the Fund for those payments.
