Regulation 12
Personnel requirements
Subregulation 1
An AOC holder must employ or otherwise engage a fit and proper person as an accountable manager who has the authority within the AOC holder’s organisation to ensure that all activities undertaken by the organisation are financed and carried out in accordance with —
the air operator certificate and its associated operations specifications; (b)these Regulations; (c)the Air Navigation (121 — Commercial Air Transport by Large Aeroplanes) Regulations 2018 or the Air Navigation (135 — Commercial Air Transport by Helicopters and Small Aeroplanes) Regulations 2018, or both (as applicable); and
the Air Navigation (98 — Special Operations) Regulations 2018 (G.N. No. S 442/2018), if applicable.
Subregulation 2
The accountable manager appointed under paragraph (1) is responsible for ensuring that —
the staffing, procedures and practices of the AOC holder’s organisation are such that flights can be conducted safely across the whole of the intended route network; and
the AOC holder’s organisation complies with the requirements of —
these Regulations; (ii)the Air Navigation (121 — Commercial Air Transport by Large Aeroplanes) Regulations 2018 or the Air Navigation (135 — Commercial Air Transport by Helicopters and Small Aeroplanes) Regulations 2018, or both (as applicable); and
the Air Navigation (98 — Special Operations) Regulations 2018, if applicable.
Subregulation 3
An AOC holder must employ or otherwise engage from individuals who are fit and proper persons, persons who —
are responsible for ensuring that the AOC holder’s organisation complies with its Operations Manual, and other procedures or manuals, as approved by the Director‑General of Civil Aviation; (b)are responsible for the functions mentioned in paragraph (5); and
are responsible to the accountable manager.
Subregulation 4
An AOC holder must employ or otherwise engage sufficient personnel to plan, perform, supervise, inspect and certify the operations listed in the procedures and programmes specified in the flight safety documents system.
Subregulation 5
Except as provided for in paragraph (6), each person mentioned in paragraph (3) must be responsible for only one of the following functions:
air transport operations, which includes flight operations and the supporting ground operations; (b)crew training and crew competency assessment; (c)continuing airworthiness management; (d)the safety management system, as described in regulation 16; (e)the quality system, as described in regulation 19.
Subregulation 6
A person mentioned in paragraph (3) may be concurrently responsible for those functions stated in paragraph (5)(d) and (e) if the Director‑General of Civil Aviation permits the person to have concurrent responsibilities as a consequence of the size and expected scope of the AOC holder’s organisation.
Subregulation 7
Every person mentioned in paragraph (3) must meet such competency requirements as the Director‑General of Civil Aviation may specify.
Subregulation 8
An AOC holder must obtain the Director‑General of Civil Aviation’s approval before employing or otherwise engaging any person mentioned in paragraphs (1) and (3) for the AOC holder’s organisation.
