Regulation 4

Aircraft airworthiness

Subregulation 1

An AOC holder may operate a relevant aircraft that does not have a valid Certificate of Airworthiness if all the following conditions are met:

(a)

the purpose of a flight is to transport the aircraft to a location where the necessary maintenance or repairs can be performed to that aircraft;

(b)

the AOC holder has a ferry flight authorisation;

(c)

the flight is conducted in accordance with the ferry flight authorisation, including any conditions or limitations imposed in the authorisation.

Subregulation 2

An AOC holder must inform the Director-General of Civil Aviation in writing of any flight operated under a ferry flight authorisation no later than 2 days after the end of the flight.

Subregulation 3

Regulation 5 of the Air Navigation (91 — General Operating Rules) Regulations 2018 does not apply when an aircraft is operated in accordance with paragraph (1).
