Regulation 15

Collection and disposal of ashes

Subregulation 1

Where the cremation was applied for under regulation 8, the ashes may be collected within 14 days after the cremation by —

(a)

the person who applied for the cremation; or

(b)

any other person who has given sufficient reason to the Director-General as to why the person should be permitted to collect the ashes instead of the person who applied for the cremation.

Subregulation 2

Where the cremation was permitted under regulation 16, the ashes may be collected within 14 days after the cremation by —

(a)

the executor of the estate of the deceased person, if any;

(b)

any surviving relative of the deceased person or stillborn child; or

(c)

any other person who has given sufficient reason to the Director-General as to why the person should be permitted to collect the ashes instead of the persons mentioned in sub-paragraph (a) or (b).

Subregulation 3

If the ashes mentioned in paragraph (1) or (2) are not collected within 14 days after the date of cremation, the ashes may be disposed of by the licensee, an authorised officer or any other person authorised by the Director-General, at a geographical area or location designated for that purpose.

Subregulation 4

Where a cremation was carried out before 20 June 2025 and the ashes are not collected within 14 days after the date of cremation, the ashes may be disposed of, on or after 20 June 2025, in the manner provided under paragraph (3).
