Application to Minister to take prohibited actions
Subregulation 1
A Town Council must apply to the Minister to take an action prohibited by rule 3 if it considers that —
(a)
the action is necessary to avoid —
(i)
injury to human life;
(ii)
serious damage to property; or
(iii)
serious jeopardy to the operations or financial position of the Town Council; and
(b)
it is not prudent or practicable to delay taking the action until the caretaker period is over.
Subregulation 2
The Minister may approve an application under paragraph (1) with or without conditions.
Subregulation 3
An application under paragraph (1), and the Minister’s decision on the application, must be made in writing.
