Appointment of Disciplinary Committee
Subregulation 1
The Minister may in writing appoint a Disciplinary Committee which shall consist of —
a registered patent agent or registered foreign patent agent;
an advocate and solicitor; and
a lay person.
Subregulation 2
The Minister shall appoint one member of the Disciplinary Committee as the president.
Subregulation 3
The members of the Disciplinary Committee shall hold office for such term as may be determined by the Minister and shall be eligible for reappointment.
Subregulation 4
Notice of the appointment of the Disciplinary Committee shall be published in the Patents Journal.
Subregulation 5
Any member of the Disciplinary Committee may resign at any time by giving notice in writing to the Minister.
Subregulation 6
If any member of the Disciplinary Committee is, by reason of illness, absence or other cause, for the time being unable to perform the duties of his office, the Minister may appoint another person to discharge the duties of that member for such term as the Minister may determine, and a person so appointed shall, during that term, have the same powers and functions as the person in whose place he is appointed.
Subregulation 7
All members must be present to constitute a quorum for a meeting of the Disciplinary Committee.
Subregulation 8
Any question arising at a meeting of the Disciplinary Committee shall be determined by a majority of votes.
Subregulation 9
In this rule, “Minister” includes the Permanent Secretary to the Ministry for which the Minister is responsible.
