Application to Court to vary list
Subregulation 1
Subject to paragraph (2), no application to the Court by any person who objects to the list of contributories as finally settled by the liquidator (called in this rule an objection application) is to be entertained after the expiration of 21 days after the date that the notice mentioned in rule 96 was served on that person, unless the Court extends the time within which an objection application may be made or otherwise allows the objection application to be made.
Subregulation 2
The Court may extend the time for making an objection application despite the fact that the application for the extension is made after the expiry of the 21 days mentioned in paragraph (1).
Subregulation 3
The liquidator is not in any case personally liable to pay any costs of or in relation to an application to set aside or vary the liquidator’s act or decision in settling the name of a person on the list of contributories.
