Regulation 6
Cancellation of insurance cover
Subregulation 1
The Board may cancel an individual’s insurance cover under the CSHL Scheme if —
the Board finds that the insurance cover in respect of the individual has been issued in error (including because the individual dies on or before the date of commencement of the insurance cover, and the Board is notified of the individual’s death only after that date); and
no claim has been accepted by the Administrator under section 16 of the Act in respect of the individual.
Subregulation 1AA
Without affecting paragraph (1), the Board may also cancel the insurance cover under the CSHL Scheme of an individual mentioned in regulation 2(1)(b) —
to whom section 6(1)(b)(iii)(A) of the Act applies — if the individual is found to have been disabled before the commencement of the individual’s insurance cover; or
to whom section 6(1)(b)(iii)(B) of the Act applies — if the individual is found to have been severely disabled before the commencement of the individual’s insurance cover.
Subregulation 1A
Without affecting paragraph (1), the Board may also cancel the insurance cover under the CSHL Scheme of an individual mentioned in regulation 2(1)(ba) if —
the individual withdraws (whether on his or her own or by an authorised applicant acting on behalf of the individual) from the CSHL Scheme before 1 January 2024 or a later date that the Board may allow;
the individual fails to pay the premium for the first insurance period of the individual’s insurance cover under the CSHL Scheme; or
at the expiry of 75 days after the renewal date of the individual’s insurance cover under the ESH Scheme, the individual fails to pay the premium under the ESH Scheme for the insurance period immediately before the commencement of the individual’s insurance cover under the CSHL Scheme.
Subregulation 1B
Without affecting paragraph (1), the Board may also cancel the insurance cover under the CSHL Scheme of an individual mentioned in regulation 2(1)(bb) if —
the individual is found to have been —
severely disabled before the commencement of the individual’s insurance cover, if the date of the individual’s application for the insurance cover was before 1 January 2026; or
disabled before the commencement of the individual’s insurance cover, if the date of the individual’s application for the insurance cover is on or after 1 January 2026;
the individual withdraws (whether on his or her own or by an authorised applicant acting on behalf of the individual) from the CSHL Scheme within a period of 60 days after the date the application is accepted under section 7 of the Act or a longer period that the Board may allow;
the individual fails to pay the premium for the first insurance period of the individual’s insurance cover under the CSHL Scheme; or
at the expiry of 75 days after the renewal date of the individual’s insurance cover under the ESH Scheme, the individual fails to pay the premium under the ESH Scheme for the insurance period immediately before the commencement of the individual’s insurance cover under the CSHL Scheme.
Subregulation 2
The cancellation under paragraph (1), (1AA), (1A) or (1B) takes effect on the date of commencement of the insurance cover issued in respect of the individual concerned, as if the insurance cover had not been issued.
Subregulation 3
Paragraphs (1A)(a) and (b) and (1B)(b) and (c) do not apply to an individual whose claim under the CSHL Scheme has been accepted by the Administrator under section 16 of the Act.
