Regulation 12

Action under section 34(1) of Act

Subregulation 1

Where the Commissioner gives notice of the intention to take any action under section 34(1) of the Act against any designated insurer for failure to comply with section 32(1) of the Act, the designated insurer may make written representations to the Commissioner in the form and manner and within the time specified in the notice.

Subregulation 2

A designated insurer’s appeal under section 34(10) of the Act against the Commissioner’s decision to do anything under section 34(1)(a), (b) or (c) of the Act must be made —

(a)

within 14 days after the date of being notified of the Commissioner’s decision; and

(b)

in the form and manner notified by the Commissioner.

Subregulation 3

The Commissioner’s decision takes effect despite any pending appeal to the Minister against the decision.
