Designated employer’s insurer to issue certificate of insurance to employer
Subregulation 1
Where a designated employer’s insurer insures an employer under an approved employee insurance policy, the designated employer’s insurer must, within 7 days after the date on which the approved employee insurance policy commences or is renewed, issue to the employer a certificate of insurance containing the following particulars:
the name of the insurer;
the name of the insured;
the date of commencement of the policy;
the date of expiry of the policy.
Subregulation 2
A person that contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction —
to a fine not exceeding $2,000; or
if the person is a repeat offender, to a fine not exceeding $4,000.
Subregulation 3
The certificate of insurance mentioned in paragraph (1) may be provided in electronic form if the information contained therein is accessible so as to be usable for subsequent reference.
Subregulation 4
In paragraph (2)(b), “repeat offender”, in relation to an offence under paragraph (2), means a person who —
is convicted, or found guilty, of an offence under paragraph (2); and
has been convicted, or found guilty, of any of the following offences on at least one other earlier occasion:
an offence under paragraph (2), whether the conviction was before, on or after 15 October 2024;
an offence under regulation 5B(2).
