Short title and commencement
This Act may be cited as the Tourist Promotion Board (Amendment) Act, 1969.

Short title and commencement
This Act may be cited as the Tourist Promotion Board (Amendment) Act, 1969.
Amendment of section 2
Section 2 of the Tourist Promotion Board Ordinance, 1963 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —
by deleting the definition of “financial year” appearing therein and substituting therefor the following: —“ “financial year” means a period of twelve months beginning on the 1st day of April, except that the period between the coming into operation of the Tourist Promotion Board (Amendment) Act, 1969 (Act of 1969), and the 31st day of March 1970, inclusive, shall be deemed to be part of the preceding financial year;”;
by inserting immediately after the definition of “financial year” appearing therein the following new definition: —“ “tourist food establishment” means any place or any premises or part thereof used for the sale or for the preparation for sale of food and drink whether cooked or not, intended for human consumption which is declared by the Minister by notification in the Gazette to be a tourist food establishment;”; and
by inserting immediately after the definition of “tourist hotel” appearing therein the following new definition: —“ “tourist public house” means any premises which have a public house licence issued under the provisions of the Customs Ordinance, 1960 (Ord. 44 of 1960), and which are declared by the Minister by notification in the Gazette to be a tourist public house;”.
Amendment of section 5
Section 5 of the Ordinance is hereby amended —
by deleting subsection (1) thereof and substituting therefor the following: —“(1) The Board shall consist of —
the Chairman;
the Director of the Board appointed under section 7 of this Ordinance; and
eight other members to be appointed by the Minister.”; and
by deleting the expression “(f)” appearing in the second line of subsection (2) thereof and substituting therefor the expression “(c)”.
Amendment of section 8
Section 8 of the Ordinance is hereby amended by inserting immediately after the words “time to time” appearing in the first line thereof the words “appoint such agents and”.
Repeal and re-enactment of section 11
Section 11 of the Ordinance is hereby repealed and the following substituted therefor: —“Imposition of a cess11.—
There shall be levied and paid to the Board or to its agents, at the end of each month —
in respect of every room or suite occupied each day in every tourist hotel; and
in respect of all sales of food and drink —
in tourist food establishments; and
in tourist public houses,a cess at the rate set out in the Schedule to this Ordinance.(2) The Minister may in such Schedule, classify tourist hotels, tourist food establishments and tourist public houses and specify the rate of cess to be paid in respect of each such tourist hotel, tourist food establishment and tourist public house.(3) The Minister may, from time to time by order published in the Gazette, add to, vary or revoke the whole or any part of such Schedule.”.
Amendment of section 12
Subsection (2) of section 12 of the Ordinance is hereby deleted and the following substituted therefor: —“(2) The Minister may, if he thinks fit, and upon such conditions as he may impose, exempt any tourist hotel, tourist food establishment and tourist public house from any cess payable under this Ordinance.”.
Amendment of section 17
Section 17 of the Ordinance is hereby amended —
by deleting the word “January” appearing in the first line thereof and substituting therefor the word “April”; and
by deleting the word “March” appearing in the second line thereof and substituting therefor the word “July”.
Amendment of section 20
Subsection (4) of section 20 of the Ordinance is hereby deleted and the following substituted therefor: —“(4) All regulations made under this Ordinance shall be published in the Gazette and shall be presented to Parliament as soon as may be after publication.”.
Repeal and re-enactment of Schedule
The Ordinance is hereby amended by deleting the Schedule thereto and substituting therefor the following: —“THE SCHEDULE(Section 11(1)).(a)For every room or suite occupied each day in every tourist hotel Three per centum of the charge for the room or suite subject to a minimum of one dollar per day.(b)For every tourist food establishment Three per centum of the charge for each item of food or drink.(c)For every tourist public house Three per centum of the charge for each item of food or drink.For the purposes of calculating the cess payable under paragraphs (b) and (c) of this Schedule, fractions of a cent shall be ignored.”.
