Clause 29
Section 55 of the principal Act is amended —
(a)
by deleting subsection (1) and substituting the following subsection:“(1) To avoid doubt, any function, power, requirement or duty conferred on a Town Council by this Act must be performed or exercised in a way that is consistent with the title and rights of the Board as owner of the common property within the Town for which the Town Council is established.”;
(b)
by deleting the words “under subsection (1)” in subsection (2) and substituting the words “by order under section 3”;
(c)
by deleting subsection (3); and
(d)
by deleting the section heading and substituting the following section heading:“Relationship between Board and Town Council”.
