Action for infringement

Clause 31
(1)
An infringement of a registered trade mark is actionable by the proprietor of the trade mark.
(2)
Subject to the provisions of this Act, the relief the Court may grant in an action for an infringement includes —
(a)
an injunction (subject to such terms, if any, as the Court thinks fit); and
(b)
either damages or an account of profits.
