Section 26C

Review of complaints and information

(1)

Subject to section 26H, the Board must —

(a)

within 2 weeks after receiving any complaint against, or information about, a registered person under section 26B, start to review the complaint or information; and

(b)

complete its review of the complaint or information within 3 months after starting the review.

(2)

The Board may, in the course of a review under subsection (1), require any of the following persons to answer any inquiry or provide any record that the Board considers relevant for the purpose of the review:

(a)

the person who made the complaint against, or provided the information about, the registered person;

(b)

the registered person.

(3)

The Board may dismiss any complaint or information where the Board is unanimously of the opinion that the complaint or information is frivolous, vexatious, misconceived or lacking in substance.

Where a complaint against, or information about, a registered person is not dismissed under subsection (3), the Board must refer the complaint or information to an Inquiry Committee.
