The accused person, A Steven s/o Paul Raj (“the accused”) was charged and convicted by me of the offence of trafficking in diamorphine. The accused did not deny possession or knowledge of the Relevant Drugs found on him (see [3(d)] for the definition of the “Relevant Drugs”); his only defence was that the Relevant Drugs were meant for his personal consumption alone. I rejected this defence, which he could not establish on a balance of probabilities. Following his conviction, I sentenced him to death, as required by law. He has appealed.
