The first defendant (“Herbs Health”) was an authorised retailer of the claimant’s (“Beauty Nation”) products. Herbs Health sold goods bearing Beauty Nation’s trade marks in a physical retail outlet and online. Herbs Health’s related entity, the second defendant (“TCM Shop”), similarly sold goods bearing Beauty Nation’s trade marks online. Further, Herbs Health and TCM Shop (collectively, the “Defendants”) advertised these goods using photographs taken by a director of Herbs Health and materials in which the copyright was owned by Beauty Nation. Beauty Nation claims against the Defendants for copyright infringement, trade mark infringement and inverse passing off for the Defendants’ online sales. The Defendants counterclaim against Beauty Nation for groundless threats of copyright and trade mark infringement proceedings. For the reasons that follow, I dismiss Beauty Nation’s claims. In respect of the Defendants’ counterclaim, I make no order as I find no basis to grant any of the reliefs asked for.
