Regulation 3

Excepted driving or riding of non‑compliant mobility vehicle

For the purposes of section 20(1)(d) and (2) of the Act, an individual may drive or ride on a public path a non‑compliant mobility vehicle of any model or description if —

(a)

the maximum speed that the mobility vehicle is capable of reaching under any circumstances does not exceed 10 kilometres per hour; and

(b)

the individual —

(i)

has been granted a valid certificate from a specified assessor certifying that the individual has a medical need to drive or ride that mobility vehicle;

(ii)

has, before 27 February 2026, received a subsidy under the Seniors’ Mobility and Enabling Fund for the purchase of that mobility vehicle; or

(iii)

has, whether before, on or after 1 June 2026, received a subsidy under the Assistive Technology Fund for the purchase of that mobility vehicle.
