Citation and commencement
This Order is the Active Mobility (Mandatory Testing — Motorised PMD with Handlebars) Order 2020 and comes into operation on 3 April 2020.
Start date for mandatory testing
Starting 3 April 2020, for the purposes of Division 2 of Part 4 of the Act, an inspection is required for and in respect of every motorised personal mobility device that —
has an electric motor attached to the device; and
has handlebars.
Periodic testing
The inspection for and in respect of every motorised personal mobility device mentioned in paragraph 2 is a periodic inspection that, subject to paragraph 4, must be carried out before the end of every 2 years after the last certification of inspection —
issued under section 35C of the Act with respect to that motorised personal mobility device; and
not cancelled or expired.
Testing not needed for deregistered PMD
However, no periodic inspection is required in respect of a motorised personal mobility device mentioned in paragraph 2 if its registration is cancelled under section 28D of the Act.
