In the principal Act, after section 35A, insert —“Permission to apply for orders consequent on foreign matrimonial proceedings, etc.35AB.—
A party to a foreign divorce or nullity of marriage who wishes to make an application for any CCCA order or FR order must first obtain the permission of the Court in accordance with rules made under section 145 to make that application.
The Court is not to grant permission unless it considers that there is substantial ground for making an application for the CCCA order or FR order.
The Court may grant permission under this section even though an order has been made by a court of competent jurisdiction in a foreign country requiring the other party to the marriage to make any payment, or transfer any property, to the party or a minor child of the parties to the marriage.
Permission under this section may be granted subject to any conditions that the Court thinks fit.”.
