Section 52

Referral and transfer of cases to Health Committee

(1)

Where, in the course of inquiring into the case of a registered allied health professional, it appears to a Disciplinary Tribunal that his or her fitness to practise may be impaired by reason of his or her physical or mental condition, the Disciplinary Tribunal may refer that question to a Health Committee for determination.

(2)

If, on a referral under this section, the Health Committee determines that the fitness of the registered allied health professional to practise is not impaired by reason of his or her physical or mental condition, the Health Committee must certify its opinion to the Disciplinary Tribunal.

(3)

If, on a referral under this section, the Health Committee determines that the fitness of the registered allied health professional to practise is impaired by reason of his or her physical or mental condition, the Health Committee must —

(a)

certify its opinion to the Disciplinary Tribunal; and

(b)

proceed to dispose of the case in accordance with section 58,and the Disciplinary Tribunal ceases to exercise its function in relation to the case.
