Regulation 3

Application

Subregulation 1

Parts II, III and IV of these Regulations apply to all building works except any of the following:

(a)

any building works for which an application for the approval of plans was submitted before 1 January 2004;

(b)

any building works for which an application for the approval of any amendment to the plans mentioned in sub‑paragraph (a) was made before, on or after 1 January 2004;

(c)

any building works for a temporary building or building works for the occupation of a temporary building;

(d)

any fixed installation works (other than fixed installation works for any supporting structure or enclosure that is used, or designed to be used, to operate a fixed installation);

(e)

any insignificant building works.

Subregulation 2

Part IVA of these Regulations applies to all building works except the building works mentioned in paragraph (1)(a), (b), (c) and (d).

Subregulation 3

Part V of these Regulations applies to the following:

(a)

all building works (except the building works mentioned in paragraph (1)(d));

(b)

all buildings (except fixed installations);

(c)

all exterior features of buildings (except exterior features of fixed installations);

(d)

all façades of buildings (except façades of fixed installations).

Subregulation 4

Part VA of these Regulations applies to the following:

(a)

all buildings (including fixed installations);

(b)

all exterior features of buildings (including exterior features of fixed installations);

(c)

all façades of buildings (including façades of fixed installations).

Subregulation 5

Regulations 45 and 46 apply to the following:

(a)

all buildings (except fixed installations);

(b)

all exterior features of buildings (except exterior features of fixed installations);

(c)

all façades of buildings (except façades of fixed installations).
