28. Evidence of carrying on business under a business name

If, in any proceedings for an offence under this Act —
proof is given that a business name has been displayed in any premises; and
business name
“business name” means the name or style under which a person carries on business;
evidence is given from which the court may infer that the business name has reference to any business carried on at the premises,the person carrying on the business shall, in the absence of proof to the contrary, be presumed to be carrying on the business under that business name. [23A

“business” includes every form of trade, commerce, craftsmanship, calling, profession and any activity carried on for the purposes of gain but does not include any office, employment or occupation, or any of the businesses specified in the First Schedule;
