Part 3 · Committee of Assessors

24. Committee of Assessors may conduct oral hearing through electronic means of communication

(1)

The Committee of Assessors may conduct the oral hearing of any matter through an electronic means of communication that —

(a)

enables live two‑way interactive audiovisual communications between each participant and all the other participants of the hearing; and

(b)

is approved by the chairperson of the Council.

(2)

To avoid doubt, the validity of an oral hearing conducted under paragraph (1)(a) is not affected by reason only of a temporary disruption in the live two‑way interactive audiovisual communications, between any participant and all the other participants of the hearing, that was insignificant and which did not affect the Committee’s duty to conduct proceedings fairly.

(3)

A Committee of Assessors must not conduct an oral hearing in relation to an exclusion order or visit limit against a person in the manner provided under paragraph (1), if to do so —

(a)

would not give the person a reasonable opportunity to be heard; or

(b)

would be otherwise inconsistent with the Committee’s duty to ensure that the hearing is conducted fairly to all parties.
