8. Review of responsible gambling measures

A casino operator shall conduct in accordance with the responsible gambling requirements a review of the responsible gambling measures contained in the approved responsible gambling programme for its casino for the purpose of comparing the quality and standard of those responsible gambling measures —

annually; or

at such lower frequency as may be specified in the Responsible Gambling Code for Casinos in substitution of sub-paragraph (a).

Subject to paragraph (3A), a casino operator shall complete the review of the responsible gambling measures contained in the approved responsible gambling programme for its casino —

where paragraph (1)(a) applies —

in the case of the first review, not later than the anniversary of the date of the Authority’s approval pursuant to regulation 5(4)(a) of the responsible gambling programme; and

in the case of the second and each subsequent review, within one year after the date of the Authority’s approval pursuant to paragraph (6)(a) of the review report in respect of the immediately preceding review; or

where paragraph (1)(b) applies, within the applicable time specified in the Responsible Gambling Code for Casinos.

Subject to paragraph (3A), a casino operator shall submit a report of the review (referred to in these Regulations as the review report) to the Authority for approval within 3 months after the casino operator completes the review in accordance with paragraph (2).

The Authority may, in any particular case, extend the time for the completion of the review under paragraph (2) or the submission of the review report in paragraph (3).

A review report must contain such matters and comply with such requirements as may be specified in the Responsible Gambling Code for Casinos.

The Authority shall not approve a review report submitted by a casino operator unless the Authority is of the opinion that the responsible gambling measures being proposed or revised therein for adoption in its casino satisfy or will satisfy all the responsible gambling requirements applicable to the casino operator.

The Authority may —

approve a review report relating to a casino subject to such conditions as it may impose; or

reject a review report relating to a casino if any part of it is not an objective assessment or does not satisfy any of the responsible gambling requirements applicable to the casino operator or does not comply with any of the requirements set out in these Regulations.

A casino operator shall —

adopt the proposed or revised responsible gambling measures in the approved review report and any conditions imposed thereon by the Authority; and

complete its adoption of the proposed or revised responsible gambling measures by the proposed date by which those responsible gambling measures are to be adopted as set out in the approved review report.

Where the adoption by a casino operator of any proposed responsible gambling measure in an approved review report it submitted requires an amendment to the approved responsible gambling programme for its casino, the casino operator shall comply with all requirements in regulation 7.
