—(1) If it appears to the Authority that —(a)the SAF levy collection agent —(i)has failed to collect any amount of SAF levy or interest, the collection of which the SAF levy collection agent is or was responsible for; or(ii)has failed to pay to the Authority within the period mentioned in paragraph 10(1) any amount of SAF levy or interest collected by it; and(b)no satisfactory explanation is provided (within a period specified by the Authority) to the Authority with regard to the failure,the Authority may impose on the SAF levy collection agent a penalty equal to that amount.(2) To avoid doubt, this paragraph does not affect any liability arising under paragraph 10(2).

reg 11Penalty in relation to SAF levy collections

(1)

If it appears to the Authority that —

(a)

the SAF levy collection agent —

(i)

has failed to collect any amount of SAF levy or interest, the collection of which the SAF levy collection agent is or was responsible for; or

(ii)

has failed to pay to the Authority within the period mentioned in paragraph 10(1) any amount of SAF levy or interest collected by it; and

(b)

no satisfactory explanation is provided (within a period specified by the Authority) to the Authority with regard to the failure,the Authority may impose on the SAF levy collection agent a penalty equal to that amount.

(2)

To avoid doubt, this paragraph does not affect any liability arising under paragraph 10(2).
