35. Preservation of secrecy

A member, an officer, an agent or a delegate of the Agency, the Chief Executive or a committee member, who has information in his or her capacity as such that would not otherwise be available to him or her, must not disclose that information to any person except —
member
“member”, in relation to the Agency, means a member of the Agency appointed under section 11, and includes any individual appointed under section 15 to act in that capacity;
in the performance of the Agency’s functions;
with the prior authorisation from the Agency to do so;
for the purposes of any proceedings for an offence under this Act, or any report of those proceedings;
as required by an order of court;
in complying with the requirements in this Act for a member of the Agency or a committee member to disclose an interest; or
as required or allowed by this Act or any other Act.
A person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months or to both.

Agency
Defined · s 2“Agency” means the Communicable Diseases Agency established by section 3;
Chief Executive
Defined · s 2“Chief Executive” means the Chief Executive of the Agency appointed under section 33, and includes any individual acting in that capacity;
committee member
Defined · s 2“committee member” means an individual appointed to be a member of a committee;
delegate
Defined · s 2“delegate” means a person to whom the Agency under section 31 delegates the performance or exercise of any of its functions or powers;
functions
Defined · s 2“functions”, in relation to the Agency, means functions conferred on the Agency by this Act or any other Act;
member
Defined · s 2“member”, in relation to the Agency, means a member of the Agency appointed under section 11, and includes any individual appointed under section 15 to act in that capacity;
officer
Defined · s 2“officer”, in relation to the Agency, means an employee of the Agency and includes an individual under a secondment arrangement which makes available the service of the individual to the Agency;
