Regulation 9
Membership agreement to incorporate membership, distribution and dispute resolution policies
Subregulation 1
The membership agreement must —
(a)
incorporate, by express reference, the CMO’s membership policy, distribution policy and dispute resolution policy; and
(b)
provide that those policies prevail over any inconsistent term of the membership agreement.
Subregulation 2
To avoid doubt, paragraph (1)(b) does not prevent a policy from providing, in accordance with regulation 17(b), 27(b) or 31(b) (as the case may be), that it is subject to a membership agreement.
