Clause 56

Power to enter and cleanse houses and buildings

(1)

A Medical Officer of Health, a Public Health Engineer or a public health auxiliary may, at any time between six o’clock in the morning and six o’clock in the evening, enter into and inspect any house or building and by an order in writing direct the owner or the occupier thereof to cause within a time and date to be specified in such order all or any part to be internally and externally limewashed or otherwise cleansed for sanitary reasons and, if necessary, disinfected and all dirt or rubbish removed or collected and burnt on the premises.

Any owner or occupier who fails or neglects to comply with such order within the time and date specified therein shall be guilty of an offence under this Act and shall be liable on conviction to a fine not exceeding one thousand dollars and to a further fine not exceeding fifty dollars for every day during which such non-compliance continues, and without prejudice to any proceedings under this subsection and whether before or after the commencement or conclusion of such proceedings, the Medical Officer of Health, the Public Health Engineer or the public health auxiliary may enter into the house or building and take such measures as have been specified in such order, and the costs and expenses thereby incurred shall be paid by the person in default and may be recovered in the manner provided under section 119 of this Act.

No entry shall be made under this section into any dwelling-house in actual occupation, unless with the consent of the occupier, without six hours’ previous notice to such occupier.
