Regulation 16

Extension of time and waiver of requirements

Subregulation 1

Subject to paragraph (3), the Appeals Board committee may extend the period prescribed by these Rules or stipulated in any order or direction of the Appeals Board committee —

(a)

for lodging any document; or

(b)

for doing anything,on such terms as it deems fit, notwithstanding that the application for extension is made after the expiration of that period.

Subregulation 2

The Appeals Board committee may waive on such terms as it deems fit any of the other requirements under these Rules if it is just to do so.

Subregulation 3

The Appeals Board committee may, in any particular case, extend the period for filing a notice of appeal or petition of appeal only if satisfied that by reason of exceptional circumstances, it is just to do so.
