Notification of accidents and dangerous occurrences
(1)
Where —
an accident in a factory —
causes loss of life to a person employed in the factory;
disables any such person for more than 3 days from earning full wages at the work at which he was employed; or
causes any injury to any such person which requires such person to be detained in a hospital for at least 24 hours for observation or treatment; or
a dangerous occurrence takes place in a factory,written notice thereof in the form set out in the Ninth Schedule shall be sent forthwith to the Chief Inspector by the occupier of the factory.
(2)
Where a person employed is involved in an accident or a dangerous occurrence and the occupier of the factory is not the actual employer of the person killed or injured, the actual employer shall, instead of the occupier of the factory, forthwith send a written notice thereof in the form set out in the Ninth Schedule to the Chief Inspector.
(3)
Where an accident causing incapacity is notified under this section, and after notification thereof the person incapacitated dies, written notice of the death shall be sent to the Chief Inspector by the occupier of the factory or the employer of that person, as the case may be, as soon as the death comes to his knowledge.[49
