Powers of Committee of Appeal

(1)

On receipt of an appeal under section 24, the Committee of Appeal may, after considering the matters mentioned in section 15(5), make an order —

(a)

dismissing the appeal and confirming the Authority’s decision; or

(b)

varying or reversing the Authority’s decision —

(i)

by classifying or re-classifying the film;

(ii)

by modifying the consumer advice in respect of a film; or

(iii)

by modifying the conditions imposed under section 18(2) or (3) in relation to the classification certificate issued in respect of the film.

(2)

The Committee of Appeal must deal with an appeal under section 24 in the same way that the Authority deals with an application for classification or re-classification of a film, and sections 15, 16 and 17 apply for this purpose as if references in each of those sections to the Authority were references to the Committee of Appeal.

The decision of the Committee of Appeal is final.

(4)

The Committee of Appeal must without delay communicate its decision on any appeal to the Authority, and the Authority must, if necessary, cancel a classification certificate or issue a fresh classification certificate, or both, in respect of the film and take any other action that is necessary to give effect to that decision.
