3. Welfare of infant to be paramount consideration

Feedback & support

In plain English

When a court decides the custody or upbringing of an infant, or the handling of an infant's property or income, it must treat the infant's welfare as the first and most important matter. Unless the infant's welfare requires otherwise, neither the father nor the mother has a stronger right than the other on these matters.
