Regulation 8

Production of licence

Subregulation 1

A holder of a licence must, without delay, show the holder’s licence when requested to do so by any police officer or authorised officer.

Subregulation 2

Where a digital licence is granted, the holder of the licence is taken to have shown the licence for the purpose of complying with a request under paragraph (1) if the holder, or a representative staff or responsible executive of the holder, produces a mobile communication device or other electronic device on which the digital licence is displayed, to the police officer or authorised officer.

Subregulation 3

However, a digital licence is not displayed for the purpose of complying with a request under paragraph (1) to produce a licence if —

(a)

the screen of the mobile communication device or other electronic device on which it is purportedly displayed is unable to be read by the police officer or authorised officer to whom it is displayed due to cracking, dimming, dirt or any other fault, damage or obstruction;

(b)

the individual holding the mobile communication device or other electronic device fails or refuses to comply with a reasonable request by the police officer or authorised officer to whom it is purported to be displayed to facilitate the reading, copying or scanning of the whole or any part of the digital licence; or

(c)

the individual holding the mobile communication device or other electronic device refuses to comply with a reasonable direction to refresh the display of the digital licence.

Subregulation 4

To avoid doubt, an individual who displays or purports to display a digital licence is not required to give or hand over, to a police officer or an authorised officer person who is requiring the licence to be produced, the mobile communication device or other electronic device on which the digital licence is displayed or purported to be displayed.

Subregulation 5

A person who intentionally or negligently contravenes paragraph (1) in connection with any licence shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
