Regulation 9

Surrender of revoked or expired licence

Subregulation 1

This regulation applies where a licence is revoked under section 66 of the Act, or expires and is not renewed.

Subregulation 2

A Licensing Officer may, in any of the circumstances described in paragraph (1), direct the former holder of a licence —

(a)

to surrender or return to the Licensing Officer, within a period stated in the direction, the revoked or expired licence; or

(b)

in the case of a digital licence, to remove, within a period stated in the direction, the digital licence from each mobile communication device or other electronic device on which the digital licence is capable of being displayed.

Subregulation 3

A person who, without reasonable excuse, fails to comply with a direction given to the person under paragraph (2) shall be guilty of an offence and shall be liable on conviction —

(a)

where the person is an individual — to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 3 months or to both; or

(b)

where the person is not an individual — to a fine not exceeding $10,000.

Subregulation 4

Any direction under paragraph (2) to return or surrender a licence does not extend to any mobile communication device or other electronic device on which a licence granted in digital form is displayed.
