Regulation 6

Conditions of gun owner’s class licence

Subregulation 1

A class licensee by virtue of paragraph 5 may handle a gun with a view to its destruction by a person mentioned in paragraph 5(a) or (b), subject to all the following conditions:

(a)

the class licensee gives a Licensing Officer written notice, at least 14 days before the date the gun is to be destroyed, stating —

(i)

the proposed disposal of the gun, and that date;

(ii)

the identity particulars and contact address of every individual before whom the destruction of the gun is to be carried out; and

(iii)

the identification mark of the gun;

(b)

before the gun is destroyed, the class licensee takes all reasonable steps necessary to secure the gun from loss or theft, or unauthorised access to it by a person who is not authorised by or under the Act to possess the gun;

(c)

the class licensee gives to a Licensing Officer, within 7 days after the destruction of the gun, a certificate from a person mentioned in paragraph 5(a) or (b) that provides evidence of the destruction of that gun.

Subregulation 2

For the purpose of sub-paragraph (1)(b), “authorised by or under the Act”, for possession of a gun, means authorised to possess the gun without committing an offence under the Act, because of —

(a)

a provision in the Act;

(b)

a licence or a class licence; or

(c)

an exemption by or under section 87, 88 or 89 of the Act.
