Infrastructure Protection (Saving and Transitional Provisions) Regulations 2019

These Regulations are the Infrastructure Protection (Saving and Transitional Provisions) Regulations 2019 and come into operation on 1 October 2019.

In these Regulations, unless the context otherwise requires —“deemed protected area” means a protected area under section 4(1) of PAPPA which is deemed by section 85(2)(a) of the Act to be a protected area declared under section 8(1) of the Act;“deemed protected place” means a protected place under section 5(1) of PAPPA which is deemed by section 85(3)(a) of the Act to be a protected place declared under section 14(1) of the Act;“PAPPA” means the Protected Areas and Protected Places Act (Cap. 256) repealed by section 84(1) of the Act;“Section 4 Direction” means a direction given under section 4(2) of PAPPA and in force immediately before 18 December 2018 in respect of a deemed protected area;“Section 5 Direction” means a direction given under section 5(2) of PAPPA and in force immediately before 18 December 2018 in respect of a deemed protected place.

Every Section 4 Direction in respect of a deemed protected area continues to apply in respect of the deemed protected area as if it were a direction made under section 21(1) of the Act.

Every Section 5 Direction in respect of a deemed protected place continues to apply in respect of the deemed protected place as if it were a direction made under section 21(1) of the Act.
