Status of APEC Secretariat
The APEC Secretariat (called in this Order the Secretariat) is an organisation of the nature indicated in section 2(1) of the Act.
The Secretariat has the legal capacities of a body corporate.
Immunities and privileges of the Secretariat
The Secretariat has the like inviolability of its official archives and premises occupied as offices as is accorded in respect of the official archives and premises of an envoy of a foreign sovereign Power accredited to the Republic of Singapore.
Sub‑paragraph (1) applies provided that the Secretariat must not permit its premises to be used as a refuge for avoiding arrest under the laws of Singapore or in any other manner incompatible with the purposes of the Secretariat.
The Secretariat has the like exemption or relief from taxes and rates, other than taxes on the importation of goods, as is accorded to a foreign sovereign Power.
Sub‑paragraph (3) applies provided that the Secretariat does not claim exemption from taxes which are charges for public services.
The Secretariat has exemption from taxes on the importation of —
goods directly imported by the Secretariat for its official use in Singapore or for exportation; and
any of the publications of the Secretariat directly imported by it,subject to compliance with any condition that the Director‑General of Customs may prescribe for the protection of the revenue.
The Secretariat has exemption from prohibitions and restrictions on importation or exportation —
in the case of goods directly imported or exported by the Secretariat for its official use; and
in the case of any publication of the Secretariat directly imported or exported by it.
Immunities and privileges of Executive Director and staff of the Secretariat
Except insofar as in any particular case any privilege or immunity is waived, the Executive Director and the staff of the Secretariat enjoy within and with respect to the territory of Singapore —
while exercising their functions as such — immunity from personal arrest or detention and from seizure of their personal baggage and inviolability of their residence and of all papers and documents relating to the work of the Secretariat;
immunity from legal process in respect of acts, including words spoken or written, done by them in their official capacity and in the discharge of their duties; and
while exercising their functions — the like exemption or relief from taxes as is accorded to an envoy of a foreign sovereign Power accredited to the Republic of Singapore.
In this Order —
“Executive Director” means the Executive Director of the Secretariat or his or her authorised representative;
“staff of the Secretariat” means all the professional staff members of the Secretariat.
Sub‑paragraphs (1) and (2) do not confer any immunity or privilege on any person who is a citizen or permanent resident of Singapore.
Publication of names
The names of the persons to whom paragraph 4 applies are to be set out in a list compiled and published from time to time by the President under section 2(3) of the Act, and the list must show in regard to each person —
the date as from which, for the purposes of this Order, he or she first held the office or employment in question; and
the date when he or she ceased to hold that office or employment.
