Status of Colombo Plan Staff College for Technician Education
The Colombo Plan Staff College for Technician Education (called in this Order the College) is an organisation of which the Government and the governments of foreign sovereign Powers are members.
The College has the legal capacities of a body corporate.
Immunities and privileges of the College
The property and assets of the College enjoy immunity from legal process, except insofar as in any particular case the College has expressly waived its immunity.
The College has the like inviolability of its official archives as is accorded in respect of the official archives of an envoy of a foreign sovereign Power accredited to the Government.
The College has the like exemption or relief from taxes and rates, other than taxes on the importation of goods, as is accorded to a foreign sovereign Power.
The College has exemption from taxes on the importation of —
goods directly imported by the College for its official use in Singapore or for exportation; and
any of the publications of the College directly imported by it,subject to compliance with any condition that the Director‑General of Customs may prescribe for the protection of the revenue.
The College has exemption from prohibitions and restrictions on importation or exportation —
in the case of goods directly imported or exported by the College for its official use; and
in the case of any publication of the College directly imported or exported by it.
Immunities and privileges of representatives of members
The Director of the Colombo Plan Bureau and representatives of member governments to the Governing Board of the College, except insofar as in any particular case any privilege or immunity is waived by the member governments whom they represent, enjoy —
while exercising their functions as such, and during their journeys to and from the place of meeting — immunity from personal arrest or detention and from seizure of their personal baggage and inviolability of all papers and documents; and
immunity from legal process of every kind in respect of words spoken or written and all acts done by them in their capacity as representatives.
In this Order, “representatives of member governments” includes the members of their official staff accompanying them as such representatives, who are —
delegates;
deputy delegates;
advisers;
technical experts; or
secretaries of delegations.
Sub‑paragraphs (1) and (2) do not confer any immunity or privilege on any person —
as the representative of the Government;
as a member of the staff of a representative mentioned in sub‑paragraph (a); or
who is a citizen of Singapore.
Immunities and privileges of Director of the College
The Director of the College, not being a citizen of Singapore, except insofar as in any particular case any privilege or immunity is waived by the Governing Board of the College, enjoys —
while exercising his or her functions as such, and during his or her journeys to and from Singapore — immunity from personal arrest or detention and from seizure of his or her personal baggage and inviolability of all papers and documents; and
immunity from legal process of every kind in respect of words spoken or written and of acts done by him or her in his or her official capacity.
Immunities and privileges of officials of the College
Officials of the College who are part of the senior administrative staff and professional staff and whose names are communicated to and are approved by the Government enjoy exemption from income tax in respect of emoluments received by them as officials of the College.
In this Order, “officials of the College” includes experts and consultants performing missions for the College.
