THE ORGANISATION

Regulation 2

Legal capacity of INTELSAT

INTELSAT is an organisation of the nature indicated in section 2(1) of the Act.

Regulation 3

Immunity from suit and legal process

Subregulation 1

INTELSAT shall have immunity from suit and legal process for the activities undertaken by the INTELSAT Asia-Pacific Regional Support Centre as listed in the Schedule.

Subregulation 2

Nothing in sub-paragraph (1) shall be construed as granting to INTELSAT immunity from suit and legal process for contravention of the Telecommunications Act (Cap. 323).

Regulation 4

Inviolability of official archives and premises

Subregulation 1

INTELSAT shall have the like inviolability of official archives and premises occupied as offices as is accorded in respect of the official archives and premises of an envoy of a foreign sovereign Power accredited to the Republic of Singapore.

Subregulation 2

Notwithstanding sub-paragraph (1), INTELSAT shall not permit its premises to be used as a refuge for avoiding arrest under the laws of Singapore or in any other manner incompatible with the purposes of the Asia-Pacific Regional Support Centre.

Regulation 5

Exemption and relief from certain taxes and rates

INTELSAT shall have the like exemption or relief from taxes and rates, other than import, export or excise duties, on any article as is accorded to a foreign sovereign Power.

Citation

This Order may be cited as the International Organisations (Immunities and Privileges) (INTELSAT) Order.

Regulation 6

Immunity and exemptions for Manager of INTELSAT

Subregulation 1

Except in so far as any particular case in which any privilege or immunity is waived, the Manager shall enjoy within and with respect to the territory of Singapore immunity from suit and legal process in respect of acts, including words spoken or written, done in his official capacity and in the discharge of his duties.

Subregulation 2

Immunity from suit and legal process under sub-paragraph (1) shall apply only for so long as he holds the office or employment as Manager and shall no longer apply when he ceases to hold such office or employment.

Subregulation 3

Nothing in sub-paragraph (1) shall be construed as granting to the Manager immunity from suit and legal process for contravention of the Telecommunications Act (Cap. 323).

Subregulation 4

For the purposes of the application of this Order, “Manager” means the Manager of the INTELSAT Asia-Pacific Regional Support Centre appointed by INTELSAT.

Subregulation 5

This paragraph shall not confer any immunity or privilege upon any person who is a citizen or permanent resident of Singapore.

Regulation 7

Publication of name of Manager

The name of the person to whom the provisions of paragraph 6 apply shall be set forth in a list compiled and published from time to time by the President under section 2(3) of the Act, and such list shall show in regard to the aforementioned person the date as from which, for the purposes of this Order, he first held the office or employment in question, and the date when he ceased to hold that office or employment.

Regulation 8

Changes in constitutional structure and activities

Nothing in this Order shall be construed as precluding the President from declining to accord the immunities and privileges referred to in this Order, when either the constitutional structure of INTELSAT or the activities of the Asia-Pacific Regional Support Centre or both, that exist at the time of the making of this Order cease to exist or become subject to modifications.
