Regulation 3

Development within conservation area

Subregulation 1

Subject to sub‑paragraphs (2) and (3), no land betterment charge is payable for chargeable consent that —

(a)

is a conservation permission granted in relation to any land within a conservation area; and

(b)

entitles a person to carry out a development for the conservation of one or more buildings on the land.

Subregulation 2

The concession in sub‑paragraph (1) in relation to the development of any land is subject to the following conditions:

(a)

the development must be carried out in accordance with the conservation permission granted for it and any other requirements of the competent authority for the purposes of conservation of the buildings on the land;

(b)

the development must be completed within the period of validity (including any extension thereof) of the conservation permission granted for it.

Subregulation 3

Where the development is for the conservation of a part of any building (including the conservation of one or more but not all of the buildings) on the land, the concession in sub‑paragraph (1) applies only to that part of the development which is for conservation.
