Section 45

Any person who without reasonable cause lodges an application based on a claim to adverse possession of registered land shall be liable to make to any person who may have sustained damage or incurred costs thereby such compensation as may be just.

Compensation under this section may be recovered in an action at law, by the person who has sustained damage or incurred costs, from the person who lodged the application.[41
