cl 22Amendment of section 53

In the AMA, in section 53 —

(a)

after subsection (3), insert —“(3A) Despite subsection (3), where a bicycle is moved to a holding yard under section 45(1)(b), it becomes unclaimed if, at the end of 7 days after the day on which the bicycle was so moved —

(a)

there is no person who appears, to the satisfaction of the Authority, to be the owner of the bicycle; or

(b)

there is such a person but that person has not exercised his or her right to recover the bicycle by a claim.”;

(b)

in subsection (5)(b), delete “or” at the end;

(c)

in subsection (5)(c), replace the comma at the end with “; or”;

(d)

in subsection (5), after paragraph (c), insert —“(ca)is a bicycle that is moved to the holding yard under section 45(1)(b),”; and

(e)

in subsection (5A)(b), replace “subsection (5)(a)” with “subsection (5)(a) or (ca)”.
