Liquor Control (Supply and Consumption) (Exemption) Order 2017

reg 1Citation and commencement

This Order is the Liquor Control (Supply and Consumption) (Exemption) Order 2017 and comes into operation on 1 August 2017.

reg 1ADefinition

In this Order, “telecommunication service” has the meaning given by section 2 of the Telecommunications Act 1999.

reg 2Application

This Order applies to a licensee holding any of the following classes of liquor licences:

(a)

a Class 3A liquor licence granted under regulation 4(1)(e) of the Liquor Control (Supply and Consumption) (Liquor Licensing) Regulations 2015 (G.N. No. S 181/2015);

(b)

a Class 3B liquor licence granted under regulation 4(1)(f) of those Regulations;

(c)

a Class 4 liquor licence granted under regulation 4(1)(g) of those Regulations.

reg 3Exemption from section 5(1) of Act

(1)

Where —

(a)

licensed premises are specified in a liquor licence; and

(b)

the licensee also supplies liquor online or through a telecommunication service,the licensee is exempted from section 5(1) of the Act for the sale of liquor online or through the telecommunication service.

(2)

A licensee is exempted from section 5(1) of the Act for the delivery of liquor to —

(a)

any other licensed premises; or

(b)

a place that is not a public place.

Subregulation 1

Where —

(a)

licensed premises are specified in a liquor licence; and

(b)

Subregulation 2

A licensee is exempted from section 5(1) of the Act for the delivery of liquor to —

(a)

any other licensed premises; or

(b)

a place that is not a public place.

reg 4Exemption from section 6(1)(a) of Act

(1)

Where —

(a)

licensed premises are specified in a liquor licence; and

(b)

the licensee also supplies liquor online or through a telecommunication service,the licensee is exempted from section 6(1)(a) of the Act for the sale of liquor online or through the telecommunication service outside of the trading hours applicable to the licensee.

(2)

A licensee is exempted from section 6(1)(a) of the Act for the delivery of liquor, outside of the trading hours applicable to the licensee, to —

(a)

any other licensed premises; or

(b)

a place that is not a public place.

Subregulation 1

Where —

(a)

licensed premises are specified in a liquor licence; and

(b)

Subregulation 2

A licensee is exempted from section 6(1)(a) of the Act for the delivery of liquor, outside of the trading hours applicable to the licensee, to —

(a)

any other licensed premises; or

(b)

a place that is not a public place.
