Suggest a correction

For the purposes of section 20, a designated entity (X) must submit key management reports in accordance with this regulation.

X must submit a key management report if any of the following events takes effect:

an individual becomes, or ceases to be, a member of X’s governing body;

a change is made to X’s constitutional documents and the change affects the size or composition of X’s governing body.

The report must be submitted to the competent authority within 30 days after the date on which the relevant event mentioned in paragraph (2) takes effect.

The report must be accompanied by a copy of X’s constitutional documents as in force on the date on which the relevant event mentioned in paragraph (2) takes effect.

The report must state the relevant particulars for each individual who is —

the reason for making the report under paragraph (2)(a);

a member of X’s governing body on the date on which the relevant event mentioned in paragraph (2) takes effect; or

a responsible officer of X on the date on which the relevant event mentioned in paragraph (2) takes effect.

For an individual mentioned in paragraph (5)(a) or (b), the relevant particulars are —

the individual’s identity particulars;

the individual’s contact address;

the office (such as president or chairperson) held by the individual as a member of X’s governing body; and

the date on which the individual assumed that office.

For an individual mentioned in paragraph (5)(c), the relevant particulars are —

the individual’s identity particulars;

the individual’s contact address;

the office held by the individual that makes him or her a responsible officer; and

the date on which the individual assumed that office.

The report must be signed by every individual who is a responsible officer of X on the date of the report.

The report must be —

made using the appropriate form;

completed in English; and

submitted to the competent authority through the Internet website at https://eservices2.mha.gov.sg/rds.
