Transitional provisions
of Medical Registration Act 1997
(1)
A lay person who was appointed as a member of the Complaints Panel before 24 January 2003, and whose term has not expired by that date, is deemed, for the purposes of section 38(1)(c), to have been nominated by the Minister for such appointment and continues to be a member of the Complaints Panel until the date of expiry of that term.
(2)
Despite sections 20, 21 and 23, the Minister may, subject to such conditions as the Minister may determine, by regulations exempt any person or person within a class of persons who, at any time on or before 24 January 2003, was engaged as a house officer, or in such other similar capacity as may be approved by the Medical Council, in a hospital or an institution approved by the Medical Council under section 25, from the requirement that the person must —
in the case of section 20(1), hold a certificate of experience;
in the case of section 20(2), 21(1) or 23, comply with section 26; or
in the case of section 21(2), hold a certificate referred to in paragraph (b) of that subsection,before the person may be registered.
