Revocation and pending clinical trials
of Medicines (Clinical Trials) Regulations 2016
Subregulation 1
The Medicines (Clinical Trials) Regulations (Rg 3) are revoked.
Subregulation 2
Where a certificate was issued for a clinical trial under the revoked Medicines (Clinical Trials) Regulations and, as on 1 November 2016 —
the trial is not concluded or terminated; and
the clinical trial certificate for the trial has not expired,then these Regulations apply to the trial —
as if the certificate is a clinical trial certificate issued under these Regulations, until the conclusion or termination of the trial;
where there is more than one sponsor for the trial, as if the lead sponsor declared for the issue of the certificate is the lead sponsor for the trial under these Regulations; and
where any consent for a person to be a subject in the trial was obtained, or need not be obtained, in accordance with the revoked Regulations, as if the consent is validly obtained, or need not be obtained, under these Regulations, until such time as the consent of another person, or the consent of a person, as the case may be, is required under these Regulations.
