Regulation 4
Master’s and shipowner’s responsibilities
Subregulation 1
The master of a ship to which these Regulations apply shall ensure that the provisions of these Regulations are complied with in relation to his ship.
Subregulation 2
The shipowner of a ship to which these Regulations apply shall, upon the request of the master of his ship, provide such assistance as is necessary for compliance with the provisions of these Regulations in relation to his ship.
Subregulation 3
Any person who contravenes paragraph (1) or (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000.
Subregulation 4
It shall be a defence for any person charged for an offence under paragraph (3) to prove —
that the deficiency in medicines or medical equipment was caused by medicines and medical equipment being used for their proper purposes and that it has not been reasonably practicable to replace them; or
that he took all reasonable precautions and exercised all due diligence to avoid the commission of the offence.
