New section 40A

The principal Act is amended by inserting, immediately after section 40, the following section:“Candidates’ photographs on ballot papers40A.—

(1)

The Returning Officer must include on every ballot paper in an election a photograph of a candidate at the election if —

(a)

the candidate delivers the photograph to the Returning Officer at such place, within such time, and in such form and manner, as the Returning Officer specifies; and

(b)

the photograph is in accordance with the Returning Officer’s specifications and requirements to ensure accuracy and consistency.(2) In the case of an election in a group representation constituency, the photographs of the candidates in each group of candidates at the election must be arranged from left to right in the order in which the candidates’ names appear on the ballot paper in the election.(3) If subsection (1)(a) or (b) is not complied with for any candidate at an election, the Returning Officer must indicate in the area designated for that candidate’s photograph on the ballot paper in the election that there is no photograph for that candidate.(4) The Returning Officer must cause to be published, as soon as practicable after the issue of the writ for an election and in such manner as will secure adequate publicity to the candidates at the election, the Returning Officer’s specifications and requirements under subsection (1)(a) and (b) for the election.”.
