Registrar’s discretionary powers

Subregulation 1

Without prejudice to any of the provisions of the Act or these Rules requiring the Registrar to hear any party to proceedings under the Act or these Rules, or to give such party an opportunity to be heard, but subject to paragraph (2), the Registrar shall, before exercising any discretionary power vested in him by or under the Act or these Rules adversely to any party to a proceeding before him, give that party an opportunity to be heard.

Paragraph (1) and rule 88 do not apply to either of the following:

(a)

the issue of a notice of intention to refuse an application for a patent under section 29A(3);

(b)

the sending of a notice of refusal of an application for a patent under section 29B(5)(b)(ii).
