Clause 1

Short title and commencement

This Ordinance may be cited as the People’s Association (Amendment) Ordinance, 1963, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.

Clause 2

Amendment of section 5

Section 5 of the People’s Association Ordinance, 1960 (hereinafter in this Ordinance referred to as the “principal Ordinance”) is hereby amended —

(a)

by deleting paragraph (b) of subsection (1) thereof and substituting therefor the following: —“(b)a Minister to be appointed by the Chairman, as Deputy Chairman;”;

(b)

by deleting paragraphs (c) and (d) of subsection (1) thereof;

(c)

by relettering paragraph (e) of subsection (1) thereof as paragraph (c) and by deleting the word “six” appearing in that paragraph and substituting therefor the word “eight”;

(d)

by relettering paragraph (f) of subsection (1) thereof as paragraph (d);

(e)

by deleting subsection (2) thereof and substituting therefor the following new subsections: —“(2) There shall be a Secretary-Treasurer who shall be a person appointed by the Chairman from among the members appointed under the provisions of paragraph (c) of subsection (1) of this section.(3) The Yang di-Pertuan Negara may, from time to time, by notification in the Gazette—

(a)

vary the number of its members any provide in what manner additional members, if any, shall be appointed; and

(b)

add to or amend the First Schedule to this Ordinance.”.

Clause 3

Amendment of section 6

Section 6 of the principal Ordinance is hereby amended —

(a)

by renumbering the existing section as subsection (1) and by deleting the expression “(e)” appearing in the first line of paragraph (a) and the expression “(f)” in the second line of paragraph (b) of that subsection and substituting therefor the expression “(c)” and the expression “(d)” respectively; and

(b)

by adding thereto the following new subsection: —“(2) The Secretary-Treasurer of the Corporation shall be the Secretary-Treasurer of the Board.”.

Clause 4

Amendment of section 7

Section 7 of the principal Ordinance is hereby amended —

(a)

by deleting the expression “paragraph (f)” appearing in the second line of subsection (1) thereof and substituting therefor the expression “paragraphs (b), (c) and (d)”; and

(b)

by deleting the expression “paragraph (f)” appearing in the second line of subsection (2) thereof and substituting therefor the expression “paragraphs (b), (c) and (d)”.

Clause 5

Amendment of section 8

Section 8 of the principal Ordinance is hereby amended by deleting subsection (8) thereof and substituting therefor the following: —“(8) If a vacancy occurs in the membership of the Corporation under paragraph (b), (c) or (d) of subsection (1) of section 5 of this Ordinance, by reason of death, resignation, revocation of the appointment under subsection (1) of section 7 of this Ordinance or for any other cause, the Chairman shall —

(a)

in the case of a vacancy under the said paragraph (b) or (c), appoint a person to fill the vacancy; and

(b)

in the case of a vacancy under paragraph (d), in consultation with the organisation concerned, appoint a person to fill the vacancy,and any person appointed under the provisions of paragraph (a) or (b) of this section shall hold office for so long as the member in whose place he is appointed would have held office.”.

Clause 6

Amendment of section 13

Section 13 of the principal Ordinance is hereby amended by deleting subsection (2) thereof and substituting therefor the following: —“(2) All cheques drawn upon the bank account of the Corporation shall be signed by any two members of the Board as may be nominated by the Board for the purpose.”.

Clause 7

New section 14A

The principal Ordinance is hereby amended by inserting immediately after section 14 thereof the following new section: —“The Corporation’s symbol14A.—

(1)

The Corporation shall have the exclusive right to the use of the symbol (hereinafter in this Ordinance referred to as the “Corporation’s symbol”) representations of which are set out in the Second Schedule to this Ordinance.(2) Any person who uses a symbol identical with the Corporation’s symbol or so nearly resembling such symbol as to be likely to deceive or cause confusion in relation to the identity of the Corporation shall be guilty of an offence and shall be liable on conviction to a fine not exceeding five hundred dollars.”.

Clause 8

Amendment of the Schedule and new Schedule

The principal Ordinance is hereby amended —

(a)

by deleting the words “THE SCHEDULE” appearing immediately after section 15 thereof and substituting therefor the words “FIRST SCHEDULE”; and

(b)

by inserting immediately after item 45 of that Schedule the following new Schedule: —“SECOND SCHEDULE”.
